Worldwide Trading Solutions OÜ, registry code 11646024 (hereinafter the Service Provider or Seller) and the customer who places an order in the Digibit.ee online store and identifies themselves by entering their personal data on the order (hereinafter the Service User or Buyer), have concluded this Online Store Terms of Use Agreement (hereinafter the Terms of Use).
Online store
1.1 The Digibit.ee online store (hereinafter the online store) is an internet store created by the Service Provider, through which the sale of products to the Service User takes place.
1.2 Digibit.ee is a registered trademark belonging to the Service Provider.
General provisions
2.1 In regulating their mutual relations, the parties to the contract are guided by the Law of Obligations Act and other laws and legal acts of the Republic of Estonia and by what has been agreed in the Online Store Terms of Use.
2.2 The Service Provider has the right to make changes to the offered online store service at any time.
2.3 The Service Provider has the right to unilaterally change the terms of the user agreement without being obliged to notify the Service User of this in writing by email.
Products and making a purchase
3.1 The products displayed in the online store are usually available in the warehouse. The availability of the products displayed in the online store may change due to technical problems in the warehouse or the online store's software.
3.2 If a product is out of stock and it is not possible to fulfil the order, the online store employee contacts the user and offers a possible new delivery time or the replacement of the product with an equivalent other product of the same price and quality, or a refund of the money paid. The money is refunded to the Service User without delay. The refund arrives in the account within 2-5 business days, but no later than 14 days after placing the order. This depends on the bank and the chosen payment method.
3.3 The displayed product images are of an illustrative nature and may differ from the actual product. The product descriptions in the online store may not be exhaustive and may contain unintentional errors.
3.4 The products offered in the online store are sold to both natural persons and legal persons.
3.5 The Service User confirms that they are at least 15 years old.
3.6 The Service User selects the desired products and undertakes to enter the data required to fulfil the order (surname, first name, contact telephone, contact email address, delivery address, postal code) and pays for the products via an online bank link, on the basis of an advance invoice, or completes an instalment application.
3.7 The Service User undertakes to provide true data necessary for fulfilling the order when placing it. The Service Provider is not liable for the non-fulfilment of the order or any consequences arising from it that are caused by incorrect data provided by the Service User during fulfilment.
3.8 The sale takes place when the Service User has sent an order through the online store's website and has paid for the order.
Prices
4.1 All prices in the online store are in Euros and include VAT.
4.2 The Service Provider has the right to change the prices displayed in the online store at any time. If the prices in the online store have been changed after the Service User has placed an order and paid for it, then the Service Provider undertakes to deliver the corresponding products to the user at the prices that were in force at the moment of the order. The Service User does not have the right to demand compensation for the price difference.
4.3 The Digibit online store reserves the right to refuse the sale if one of the following problems has occurred with the Goods: a human error has occurred when entering the price or a technical error in the system (for example, if a laptop costing 800 EUR is on sale for 100 EUR, this is an obvious error. Accordingly, we assume that the Buyer should understand that this is an error and the product is not subject to sale at such a price).
Delivery time and delivery conditions
5.1 The delivery time from the moment of ordering is 1 business day (if the goods are available on site at the store) up to 14 business days (available in the warehouse). The approximate delivery time is shown on the product page.Digibit.ee offers 4 different transport options:
Free delivery
Buy for at least 150 EUR and we will deliver your purchases to you within Tallinn free of charge.
Parcel machines
Itella SmartPost (www.smartpost.ee), Omniva (www.omniva.ee), DPD (www.dpd.ee). If the goods do not fit into a parcel machine, they are brought directly to the customer at the address indicated in the order by Omniva, DPD or Cargobus courier for an additional fee. The delivery time of the goods is agreed with the customer in advance by phone.
To a post office
The goods are delivered to the nearest post office according to the customer's location. The customer is sent a notice about the arrival of the goods at the post office.
It is possible to order goods to a post office that weigh less than 30 kg and whose dimensions are smaller than 180x80x60cm.
By courier to your home or office
The delivery time of the goods is agreed with the customer in advance by phone. Home delivery to the customer is possible between 9:00 and 19:00 Mon-Fri.
The goods are delivered to the customer up to the staircase door for up to 30 kg. If the weight of the goods exceeds 30 kg, delivery is only possible if the customer assists the courier with unloading.
Delivery to the floor is for an additional fee.
If the goods are heavier than 30 kg or the longest side of the product exceeds 175 cm, the delivery cost of oversized goods is calculated separately and the customer is contacted regarding the additional fee.
5.2 After the contract enters into force, the goods are delivered to the ordered address in accordance with the order terms and at the time agreed with the customer in advance.
5.3 The goods are delivered within the approximate time indicated on the product page.
5.4 If Digibit.ee is unable to deliver the goods at the previously promised time for reasons beyond Digibit.ee's control (the product is temporarily out of stock, the supplier is delayed), Digibit.ee will inform the customer at the earliest opportunity by email or phone within 3 business days from the entry into force of the contract and provide a new delivery time.
5.5 The courier company delivers the products to the address indicated by you when placing the order. It is not possible to change the destination later.
5.6 Please check that the contact details provided when placing the order are correct in order to avoid delays and misunderstandings in the delivery of the products. Worldwide Trading Solutions OÜ and the courier company are not liable for delays in the delivery of products and for any misunderstandings if the delay or misunderstanding is caused by the inaccuracy or incorrectness of the data you provided when placing the order.
5.7 The products are handed over to you by the courier together with a delivery note. Before signing the delivery note, we strongly recommend that you inspect the packaging of the products and, in the case of external damage, note it accordingly on the courier's delivery note. Please report a product with damaged packaging to the email address sales@digibit.ee.
5.8 Upon handover of the goods to the Buyer, the Service User must, together with the courier or, upon physical receipt of the goods at the Store, together with Digibit.ee or its authorised representative, check the condition of the shipment and the Goods and sign the shipment handover-acceptance document. If the Service User has signed the shipment handover-acceptance document, the Goods are deemed to have been handed over in good condition, without damage the cause of which is classified as a manufacturing defect, and without defects in the completeness of the Goods (such as can be detected during a visual inspection of the product). If the Buyer notices that the packaging of the delivered Goods is damaged (crumpled, wet or otherwise externally damaged), the Goods are damaged and/or the Goods are incompletely assembled, the Buyer must note this on the goods handover-acceptance document in the presence of the courier or, upon physical receipt of the goods at the Store, in the presence of Digibit.ee or its representative, and draw up a free-form report of the damage/non-conformity of the shipment and/or the Goods. If the Service User fails to perform such actions, the Service Provider is released from liability for damage to the goods, unless the cause of such damage is a manufacturing defect, or for defects in the completeness of the Goods only if
such non-conformities can be detected by an external inspection of the goods.
5.9 The Service User is obliged to accept the order at the specified time and place.
5.10 The delivery service attempts to deliver the order to the recipient at least three times, after which it may return the order to the seller or keep it
in its own warehouse for storage, for which (as well as for repeated delivery) it may charge an additional fee according to its applicable tariffs.
5.11 If the Buyer does not come to collect the Goods within 14 (fourteen) days at the latest after the agreed date of receipt of the Goods, it is deemed that the Buyer
has breached the Sales Contract and does not want the Goods. The Seller has the right to unilaterally withdraw from the Sales Contract and demand compensation for damages (for example, storage costs of the goods) and
offset the damage borne by the Seller against the amounts paid in advance by the Buyer.
5.12 If the Service User refuses to accept the order without good reason or delays acceptance, the Service Provider has the right to bring the order
back to the Service Provider's location, of which the Service User is notified without delay, but no later than within 3 business days of the order arriving back at the Service Provider's location.
In such a case, the order is deemed to have been handed over to the Service User. In addition to the price of the order, the Service User must also pay the costs of delivering the order to the Service Provider's location
or to another location desired by the Service User and of returning it to the Service Provider's location, as well as the storage costs of the order at the Service Provider's location.
5.13 If the Service User refuses to accept the order without good reason or delays acceptance and the order arrives back at the Service Provider's location, the Service Provider has the right to demand from the Service User storage costs in the amount of 1% of the total price of the corresponding order per day.
5.14 If the Service User refuses to accept the order without good reason or delays acceptance, the Service Provider has the right to demand from the Service User compensation for the costs and damage that the Service Provider bears in connection with the fact that the Service User did not accept the order.
Securing the contract
6.1 If the Service User wishes to withdraw from the contract after placing the order and before the Provider's fulfilment of the contract, then the Service User undertakes to notify the Service Provider of this in writing as soon as possible. The written notice must be sent to the email address sales@digibit.ee. The email must indicate the order number from which withdrawal is desired and add the Service User's contact details
(first name, surname, order placement date, contact telephone, account number). If desired, the standard withdrawal statement form may also be used:

6.2 If the withdrawal statement reaches the Service Provider after the Service Provider's fulfilment of the contract, then withdrawal from the contract takes place in accordance with the "Right of return" chapter of the Online Store Terms of Use.
6.3 The Service Provider transfers the paid amount to the buyer upon receipt of the returned goods without delay, but no later than 14 days from the receipt of the withdrawal statement.
6.4 The money is transferred to the same bank account from which it was received by the Service Provider.
Right of return
7.1 Contracts concluded in the online store are subject to a 14-day right of withdrawal from a contract concluded by means of distance communication. The deadline starts from the day on which the goods are delivered to the Service User. If the Service User has decided to withdraw from the contract, they have the obligation to return the goods to the Service Provider.
7.2 The returned product must not be damaged and must be complete and in its original packaging. In order to exercise the right of withdrawal and to avoid paying compensation upon return, the product packaging must be opened carefully without damaging it. To familiarise yourself with the goods, you may use them in the manner necessary to ascertain the nature, characteristics and functioning of the item. If the product was purchased as part of a campaign
in which another product was added to the goods, you must return the entire set (i.e. all the products).
7.3 The right of return does not extend to audio and video recordings and computer software with opened packaging.
7.4 To return a product, a withdrawal notice must be submitted to the email sales@digibit.ee
7.5 Upon withdrawal from the contract, the consumer must return the purchased item without delay, but no later than 14 days after notifying of the withdrawal from the contract.
7.6 Upon return, the money is refunded to the Service User without delay, but no later than 14 days from the receipt of the withdrawal statement by the Seller.
7.7 The money is transferred to the same bank account from which it was received by the Service Provider.
7.8 The 14-day right of return does not apply in the case of the following goods - products that have been made taking into account the Service User's personal needs, as well as audio and video recordings and computer software whose packaging the Service User has opened.
7.9 If the returned product (and the product packaging) has deteriorated and the deterioration is caused by circumstances that are not due to Smartech shop OÜ; and as a result of the improper use of the product, Smartech shop OÜ has the right to offset the decrease in the value of the product against the amount you paid for the product and which is to be refunded to you. For the offset, Smartech shop OÜ sends you an offset statement to the email address you provided when placing the order. If you do not agree with the decrease in value indicated in the offset notice, you have the right to involve an independent expert to determine the decrease in the value of the product. The costs associated with the expert assessment are shared equally between you and Smartech shop OÜ, except when one party's position turns out to be clearly unfounded. In that case, the costs associated with the expert assessment are borne by the party whose position turned out to be clearly unfounded.
Procedure for filing complaints
8.1 Products sold in the online store are subject to the 2-year complaint filing period provided for in § 218 (2) of the Law of Obligations Act.
8.2 The buyer has the right to turn to the online store within two months at the latest of the defect becoming apparent.
8.3 The handling of complaints takes place in accordance with the "Smartech Shop OÜ procedure for handling complaints" which is annex no. 1 to the Online Store Terms of Use.
8.4 Smartech shop OÜ is not liable for:
the deterioration/damage of the product through your fault.
defects that have arisen as a result of the improper use of the product.
the normal physical wear and tear of the product under normal use.
Personal data and its use
9.1 The Service User gives clear and informed consent to the Service Provider for the processing of their personal data.
9.2 The Service User's personal data entered by the user when placing an order and made known to the Service Provider are entered into the customer register and used for providing the sales service and offering goods to the Service User.
9.3 When card details are requested, secure SSL data communication and the MasterCard SecureCode and Verified by Visa security systems are used.
9.4 The Service Provider does not see the entered card details. To carry out the transaction, the cardholder is directed to the secure environment of the Card Centre. At the moment of payment, the cardholder's card details are entered by the cardholder into a database located on the Card Centre's server, and the data are also stored on a server located at the Card Centre.
9.5 The source of the personal data is the emergence of the customer relationship upon registering an order in the online store.
9.6 The composition of the personal data to be registered includes data about the Service User's order - personal identification code, surname, first name (first names), street, house, apartment number, settlement or city, postal code, telephone number, address, year of birth, gender, delivery method, payment method used, agreement with the Online Store Terms of Use, agreement to receive sales offers, notes entered as free text at the email address.
9.7 The Service User's personal data that are necessary for delivering the goods to the Service User are forwarded to the company providing the courier service.
9.8 The protection of personal data is ensured by all security measures arising from the law.
9.9 The Service Provider undertakes not to forward the registered personal data to third parties.
9.10 The Service Provider reserves the right to forward personal data concerning the Service User to persons who have a legal right to it and who process the data to fulfil an obligation provided by law, and to persons who have a legal right to it and where this takes place for the protection of the life, health or freedom of the Service User or another person.
9.11 The Service User has the right to check the personal data concerning themselves, as well as to change them or request the removal of their personal data from the register.
9.12 The Service User gives the Service Provider consent to send an order confirmation to the email address entered when placing the order.
Liability
10.1 The Service Provider bears liability to the extent of the product's sales price. The Service Provider does not assume liability for damages caused by defective products, such as damage to property or information, loss of turnover or profit.
10.2 The Service User undertakes to use the online store service only in accordance with the law and good practice.
10.3 The Service User is responsible for procuring and maintaining the software and data communication systems of all the equipment required for use, as well as for other expenses caused by using the online store Service.
10.4 The Service User is fully liable for damage caused to the Service Provider, other Service Users or third parties by use of the online store that is contrary to the terms of the Online Store Terms of Use and to the law or good practice.
Disputes
11.1 Disputes arising from the Online Store Terms of Use between the Service User and the Service Provider are resolved in accordance with the legal acts in force in the Republic of Estonia. If an agreement is not reached, the dispute is resolved in Harju County Court.
11.2 In the Republic of Estonia, the out-of-court body resolving complaints out of court is the consumer disputes committee operating at the Consumer Protection and Technical Regulatory Authority (https://komisjon.ee/et). The committee is competent to resolve disputes arising from a contract concluded between a consumer and an undertaking that the parties have not been able to resolve by agreement. Reviewing a complaint at the committee is free of charge.
11.3 The European Union platform for resolving consumer disputes, which allows consumers and traders to resolve disputes related to online purchases with the help of an impartial dispute resolution body.
Terms of use
12.1 Familiarising oneself with the conditions set out in the Terms of Use is mandatory for the Service User.
12.2 By marking a tick in the corresponding box "I agree with the online store terms of use" when placing an order, the Service User agrees that they have familiarised themselves with the conditions set out in the Terms of Use, understood them and agree with the conditions set out in the Terms of Use.
